Marriage / Civil Unions & Domestic Partnerships
Couples must apply in the municipality where either partner legally resides if they are being married in New Jersey. The license may then be used throughout the State. If both reside outside of New Jersey, the couple must apply in the municipality where the ceremony will take place. The license will only be valid in that town.
Domestic Partnership
Couples interested in applying for a domestic partnership must be 62 years of age or older.
Resident of Toms River or Non-Resident of the state being married in Toms River
Applications for marriages/re-marriages are done Monday -Friday 8:30 a.m. to 3:30 p.m. No appointment necessary. You must show valid photo identification (such as driver's license or passport) and proof of Toms River Township residence (if it is not on their driver's license). Suggested additional documents include birth certificates (passport can be used as substitute) and, if either applicant has been married or in a Civil Union previously, they should bring divorce/dissolution papers or a death certificate to prove the termination of the prior marriage/civil union. One witness must be present with the couple. The witness must be over the age of 18 and have valid photo identification with current address. The witness cannot also be the officiant.
Documents & Waiting Period
Suggested additional documents include birth certificates (passport can be used as a substitute) and if either applicant has been married or in a civil union previously, they should bring divorce/dissolution papers or a death certificate to prove the termination of the prior marriage/civil union. Please be advised, there is a 72 hour waiting period from the time of application and the time the license can be issued.

Requests for vital records must include:
- A completed application (subject’s full name, the exact date of the event, the full name of parents at the time of the event)
- A copy of the proof(s) of your identity
- The correct fee - $15 per copy
- Proof of your relationship to the person listed on the vital record you are requesting
Proof of Identity
To show your proof of identity, you may show a valid photo driver’s license or nondriver's license with your current street address or two alternate forms of valid ID showing your current address such as:
- Bank statement within the previous 90 days
- County ID
- Federal/State ID
- Immigrant VISA
- Permanent Resident Card (Green Card)
- School ID
- US/Foreign Passport
- Utility bill(s) within the previous 90 days
- Vehicle insurance card
- Vehicle registration·
- Voter registration
- W2 or tax return for the current year
Applicants with No Identification
People who are homeless or without identification at all, but have a social worker/case manager or homeless shelter coordinator, etc. may have their social worker/case manager submit for them. Please contact the office for information on how they can assist clients that need to obtain necessary records.
Documentary Proof
You must establish your relationship to the subject of a vital record, pursuant to regulations established by the New Jersey State Registrar and Governor’s Executive Order, to obtain a vital record. You must show documentation, in addition to your photo drivers license. This chart explains who is eligible and the documentary proof to establish that eligibility. Please bring certified copies with a raised seal.

All relationships must be established with certified copies of appropriate records. Per Governor’s Executive Order 18, certified copies, will only be issued if all the following criteria are met:
- The applicant must be 18 years of age or older.
- Must be the subject on record:
- Subject’s child
- Subject’s grandchild
- Subject’s legal guardian
- Subject’s legal representative
- Subject’s parent
- Subject’s sibling
- Subject’s spouse
